We believe everyday essentials should be simple, practical and thoughtfully made. We aim to bring that same approach to your experience shopping with us.

This website, untoxed.co, is operated by an Australian sole trader trading as UNTOXED.

Throughout these Terms of Service, the words "UNTOXED", "we", "us" and "our" refer to the business operating this website.

Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer our products and services.

By accessing our website, browsing our products or placing an order, you agree to these Terms of Service, subject to your rights under applicable law.

Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law or any other applicable law where those rights cannot lawfully be excluded.

By using our website, you agree to use it lawfully and provide accurate, current and complete information when placing orders or creating an account.

You must not use our website to engage in fraudulent activity, interfere with its security, introduce malicious software, infringe intellectual-property rights or otherwise misuse our services.

If you create an account, you are responsible for keeping your login information confidential and notifying us if you become aware of unauthorised activity.

We reserve the right to restrict access where reasonably necessary to protect our customers, website or business, or to comply with applicable law.

2. Our Products

We aim to describe our products clearly and accurately, including their materials, features, compatibility and recommended use.

Some UNTOXED products are made using natural materials such as bamboo, silk and natural fibres. Minor variations in colour, texture and appearance may occur due to the nature of these materials.

We make reasonable efforts to ensure product images accurately represent the items sold. However, colours and appearance may vary slightly depending on your screen settings.

Please review the product information, materials, usage instructions and compatibility details before purchasing.

We may update product descriptions or discontinue products from time to time.

All products remain subject to applicable Australian Consumer Law guarantees, including requirements relating to acceptable quality, fitness for purpose and correspondence with their descriptions.

3. Product Compatibility

Certain products, including our electric toothbrush heads, are designed for use with selected third-party products or devices.

References to third-party brands are for compatibility and identification purposes only.

UNTOXED is an independent business and is not affiliated with, sponsored by, endorsed by or associated with Philips or Philips Sonicare.

4. Orders and Purchases

When you place an order, you are making an offer to purchase the selected products.

Orders are subject to availability, successful payment and acceptance by UNTOXED.

Once your order has been confirmed, we will arrange processing and dispatch in accordance with our Shipping Policy.

We aim to maintain accurate product availability and pricing. However, occasional errors may occur.

If we are unable to fulfil your order, we will contact you as soon as reasonably possible to discuss available options, including a refund where appropriate.

If you need to change or cancel an order, please email info@untoxed.co as soon as possible. We'll do our best to assist, although changes may not be possible after an order has been processed or dispatched.

Your statutory cancellation, refund and other consumer rights remain unaffected.

5. Pricing and Payments

Prices displayed on our Australian storefront are in Australian dollars (AUD) unless otherwise stated.

Prices include GST where applicable.

Delivery charges and any other applicable fees will be displayed during checkout before your order is completed.

We may update product prices, discounts and promotions from time to time. Any change to pricing will not retrospectively alter a confirmed order except as permitted by law or agreed with you.

Payments are processed securely through Shopify and its supported payment providers.

By placing an order, you confirm that you are authorised to use the selected payment method and that the payment information you provide is accurate.

6. Shipping and Delivery

UNTOXED generally aims to dispatch orders within 1–2 days of receiving an order.

We offer free standard shipping on orders over $65.

For orders of $65 or less, standard shipping costs are calculated at checkout.

Express shipping is also available at an additional cost, with the applicable rate displayed during checkout.

Delivery times depend on your location, shipping method and carrier.

Estimated delivery periods are guides rather than guaranteed arrival dates.

If an order is significantly delayed, lost or damaged during delivery, please contact us so we can investigate and arrange an appropriate resolution.

Nothing in these Terms removes or restricts our obligations under the Australian Consumer Law.

7. Returns, Exchanges and Refunds

UNTOXED offers a 30-day change-of-mind returns policy, subject to the conditions in our Refund & Returns Policy.

Eligible change-of-mind returns must be requested within 30 days of receiving your order.

Products must be unused, in their original condition and in their original, unopened packaging.

For hygiene reasons, opened toothbrushes, toothbrush heads, dental floss and other opened personal-care products are not eligible for voluntary change-of-mind returns.

Customers are responsible for return postage costs associated with change-of-mind returns.

Sale and clearance items and gift cards are also excluded from our voluntary change-of-mind returns policy.

These conditions do not limit your rights under the Australian Consumer Law.

If a product is faulty, damaged, incorrectly supplied or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a refund, replacement, repair or other remedy regardless of the change-of-mind exclusions or 30-day timeframe.

8. Australian Consumer Guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

These include guarantees that goods will be of acceptable quality, fit for their intended purpose where applicable, and match their description.

If a product has a major problem, you may be entitled to choose between a refund and a replacement, together with compensation for reasonably foreseeable loss or damage where applicable.

For a minor problem, we may first provide a repair or another appropriate remedy. If the issue cannot be resolved within a reasonable time, you may be entitled to a refund or replacement.

Your rights under Australian Consumer Law apply independently of any voluntary returns policy or warranty offered by UNTOXED.

Nothing in these Terms limits, excludes or modifies those rights.

9. Promotions and Gift Cards

From time to time, UNTOXED may offer promotions, discount codes, special offers or gift cards.

These offers may be subject to additional conditions, eligibility requirements and validity periods, which will be stated when the offer is made.

Promotional conditions will be applied in accordance with applicable Australian law, including consumer guarantees and gift-card requirements.

10. Product Care and Use

Please follow the usage and care instructions provided with your product or displayed on the relevant product page.

Some products made with natural materials may require particular care.

For example, bamboo and natural bristles should generally be cleaned and allowed to dry thoroughly between uses, as explained in the relevant care instructions.

You may browse and use the website for lawful, personal shopping purposes.

However, any sales and purchases you make through our store are made directly with UNTOXED.

Shopify is not the seller of products purchased from UNTOXED and is not responsible for the fulfilment of our customer orders or the performance of our obligations as the seller.

By using the Services, you acknowledge that Shopify is not responsible for aspects of sales between you and UNTOXED, including injury, damage or loss resulting from products purchased through our store, and you release Shopify and its affiliates from claims and liabilities relating to those transactions to the extent permitted by applicable law.
